Terms and Conditions

Welcome to GIGAPANDA! This document explains how our services work and the commitments we make together. When you buy on our platform, you enter into an agreement with INTI MOBILE S.A.C. (RUC 20614333597), with registered address at Av. Abel B. Du Petit Thouars 1775, Lince, Lima.

1. About your registration and purchase

To purchase your eSIM you must accept these terms and, only if you so decide, create an account. By making the purchase, you accept the selected data plan and the corresponding charges. Once we deliver the eSIM to you (via QR code), you are responsible for its use; therefore, if your device is damaged for reasons beyond our responsibility, is lost or similar, the full payment for the service remains due and the consequences of this will be outside our responsibility.

2. Data plans and geographic availability

  • Specific plans: At GIGAPANDA we offer data plans designed for specific countries. You can search, select and buy these plans directly on our website.
  • Restrictions: We reserve the right to restrict or modify the availability of our data plans in certain jurisdictions or regions as necessary.
  • Compatibility: To enjoy the service, your device must be compatible with eSIM technology and must not have a SIM block or SIM lock. We recommend checking this before your purchase.

3. Plan duration and use

  • Activation: The plan is activated when you download the eSIM and connect to the network. You may choose to remove the eSIM at any time through your device settings; however, we suggest that you do not delete the eSIM from your device until the plan has expired or the data has run out, since the code can only be used once.

Please also keep in mind that downloading the eSIM and activating any of the plans we offer requires a stable internet connection.

  • Validity: The contract ends when you use up your data or the plan’s validity period expires. If you keep the eSIM on your device after this, it will be considered delivered “as is” without active support until you make a new purchase.

Likewise, please keep in mind that if the eSIM goes unused for six (6) months, it will be deleted from the provider’s systems and can no longer be used.

Finally, please bear in mind that we may suspend or cancel the use of the eSIM or data plan in the event of a verified breach of these Terms and Conditions.

4. Service quality and availability

At GIGAPANDA we work hard to keep you connected, but please bear in mind that:

  • Local networks: The service depends on international providers. Signal may vary due to network maintenance, geographic location (mountains, basements) or weather. We cannot guarantee the full capacity or quality of third-party networks.
  • Unlimited Plans: If you purchase an “unlimited” Data Plan, please note that the speed may be subject to the local network provider’s Fair Use Policy. To ensure high quality service for everyone, the provider may limit the speed if usage is considered excessive or affects network performance for other users. In destinations such as the USA or Europe, after using the daily high speed GB, you will continue browsing without limit at a reduced speed.
  • Network maintenance: When our service providers need to carry out improvement, upgrade or technical maintenance work on their networks, the full capacity or quality of the connection may not work at 100%.

5. Your responsibilities as a user

To ensure a safe and fair experience for all our travelers, by using GIGAPANDA’s services you agree to the following:

  • Correct and lawful use: Use the eSIM in accordance with these Terms and Conditions and always respecting the laws and regulations in force in the country where you are or reside.
  • Network integrity: Do not use the service for fraudulent, criminal or illegal activities, or to carry out actions that may alter or damage the operation of the network.
  • Respect for Intellectual Property: Do not copy, modify, publish or distribute GIGAPANDA’s commercial information or trade secrets without our express authorization. Make sure that your use of the eSIM does not infringe the intellectual property rights of third parties or our own.
  • Responsible Consumption: Do not use the eSIM to download, send or upload content that, due to its excessive size, quantity or frequency, may overload or affect the service.
  • Fair play in promotions: Accept that any benefit, credit or promotion must be used honestly. Creating fake accounts or using fictitious identities to obtain undue advantages is not allowed; any attempt to undermine the integrity of our occasional promotions will void the benefit.

Consequences of non-compliance:

Please note that failure to comply with these commitments entitles GIGAPANDA to take the following measures:

  • Service Suspension: We may suspend the use of your eSIM or data plan if a breach of these terms is detected. In this case, the user remains responsible for paying any outstanding charges related to the suspension.
  • Legal action: We reserve the right to claim compensation for damages (including legal expenses) for any improper use, in accordance with applicable law.
  • Account closure: At our discretion, if objective and reasonable grounds are duly substantiated, we may delete your account from our website and prevent future use of our services or promotions if misuse of the system is proven.

6. Payment terms

To make your purchase experience clear and secure, we apply the following conditions:

  • Secure processing: You can buy your eSIM on our website. Payment is processed securely through our payment processors (Izipay, Culqi, PayPal and Aloha Pay), depending on the currency and payment method you choose.
  • Payment methods: You can buy your eSIM with the following payment methods:
  • Visa, Mastercard, American Express and Diners Club debit and credit cards.
  • PayPal.
  • Yape, in Peruvian soles.
  • PIX, in Brazilian reais.
  • Wallets and bank transfers in Colombian and Argentine pesos.
  • Prices and transparency: All our eSIMs work on a prepaid basis. The prices shown include the applicable taxes, such as IGV, and are the amounts charged at the time of payment.

7. Intellectual Property Rights

All the effort we put into our technology and design is legally protected. Therefore, it is important to consider the following:

  • Our property: Unless otherwise indicated, the eSIM, the source code, the databases, the software, the website designs, as well as the texts, photographs, audio, videos and graphics (together, the Content), are owned by GIGAPANDA or licensed to us. Likewise, the trademarks, logos and service marks belong to us and are protected by intellectual property and copyright laws.
  • Restrictions on use: Copying, reproducing, publishing, distributing, selling or commercially exploiting any part of the eSIM, the website, the Content or the trademarks without our prior written permission is not allowed. Access to our platform is for your personal use as a consumer of the service.

8. Governing law and legal compliance

For your peace of mind, we define the laws under which we operate:

  • Laws of Peru: Unless the law provides otherwise, these Terms and Conditions are governed by the laws of Peru. Any dispute or claim related to our service will be resolved exclusively before the courts of Peru.
  • Local laws: Please note that, depending on where you use your eSIM, mandatory laws of other states may also apply.
  • Responsible use according to location: Our service and website are not intended to be used in countries or jurisdictions where their use is contrary to law. If you decide to access our platform from a place where prohibitions exist, you do so at your own risk and you are responsible for complying with local laws.

9. Changes to these terms and conditions

Since the digital world changes quickly, we may update this agreement:

  • Publication of updates: Any new version of these terms or the introduction of new conditions will always be available on our website.
  • Notices: We will inform you of important changes to this Agreement through the corresponding notice. Once you receive the notice, you are free to stop using the service if you do not agree, except in the following cases:
    • When the change is exclusively for your benefit.
    • When it is a purely administrative change.
    • When the change is required by law.
  • Acceptance: If you continue to use the service after the changes take effect, we will understand that you have accepted the new conditions.

10. General provisions

Finally, some administrative points about our business relationship:

  • Transfer of rights: GIGAPANDA may assign, transfer or delegate its rights and obligations under this agreement to any company without the User’s prior consent. If this happens, the User will be informed in due course.
  • Validity of the agreement: If at any time a part of this agreement becomes illegal or unenforceable, that part will be modified or removed only to the extent strictly necessary for the rest of the contract to remain legal, valid and in force.
  • Exercise of rights: If at any time we do not apply a right or are late in doing so, this does not mean that we are waiving it. We may exercise our rights and legal remedies at any later time within the legally established periods. All the rights provided for in this agreement are in addition to those already granted to you by law.
